I'm sure you've heard about Bruce Hanes, the Register of Wills for Montgomery County, Pennsylvania, who began issuing marriage licenses to same-sex couples last week, in defiance of state law. Hanes says the law is unconstitutional and he's not bound by it. Two suits have been filed to stop him, but the courts aren't moving.
The interesting thing is that the courts are mum. I can hardly wait to see how this works out.
Same-sex marriages are continuing to take place in Montgomery County, Pennsylvania, where Registry of Wills Bruce Hanes began offering licenses over a week ago. In that time, over 40 couples have obtained licenses, and despite requests from state officials, no court has intervened. Since there has been no response to the Pennsylvania Health Department’s first suit, attorneys have now requested expedited action:
The clerk is repeatedly, continuously, and notoriously acting in clear derogation of the Marriage Law. Many agencies of government — federal, state, and local — as well as persons and entities in the private sector may be misled by invalid marriage certificates that purport erroneously to certify that same-sex couples are married under the laws of Pennsylvania.
The interesting thing is that the courts are mum. I can hardly wait to see how this works out.
