The Dreamers Can Keep Dreaming -- For Now

This "conservative" Supreme Court has handed Trump a double whammy this week, first deciding that "sex" as used in the Civil Rights Act of 1964 includes sexual orientation and gender expression, and now cutting his attempt to cancel DACA off at the knees -- on a technicality. Ian Milhauser examines the decision:

The legal issue in Department of Homeland Security v. Regents of the University of California, an extraordinarily narrow decision preserving the Deferred Action for Childhood Arrivals program, is quite small: whether the Trump administration completed the proper paperwork when it decided to wind down the program.

In a 5-4 decision, the Court held that the administration’s paperwork was insufficient, keeping the program alive for now.

They're so incompetent they can't even get the paperwork right. This is the key element:

The basic rule underlying Regents is that, even when a federal agency has discretion to implement a particular policy, it typically may not do so until it has provided a reasoned explanation for why it chose that policy. Though a court may not “substitute its judgment for that of the agency,” the same court has a duty to assess whether the agency’s decision “was ‘based on a consideration of the relevant factors and whether there has been a clear error of judgment.’”

This means DHS can try again. Hopefully, they'll as be so busy trying (and failing) to get the "president" re-elected that they won't have time.

Another Empty Threat

Ladies and Gentlemen, the President of the United States:

President Donald Trump indicated he wouldn’t allow federal aid for states facing budget deficits from the coronavirus outbreak unless they take action against “sanctuary cities” — municipalities that prevent their police from cooperating with immigration authorities.

“We would want certain things” as part of a deal with House Democrats to aid states, he said at a White House event on Tuesday, “including sanctuary city adjustments, because we have so many people in sanctuary cities.”

“What’s happening is people are being protected that shouldn’t be protected and a lot of bad things are happening with sanctuary cities,” he added. Trump has long complained about the cities and has previously sought to cut off their federal funding unless they end the policies.

He's really good at making threats. Unfortunately for him, they generally amount to nothing -- but that's not the point: he assumes that those on the receiving end with fold. Unfortunately for him, as commenter ColoMtnWoman points out, this issue has been litigated, and he lost. (Actually, a quick google search shows that the Trump administration has lost cases on this issue in the Ninth, Seventh, and First Circuits, and won a case in the Second Circuit. It appears that the Supreme Court has yet to rule on this issue.)

There's also the fact that Congress has the authority to allocate funds, not the Executive: if Trump wants to withhold grants to states, he has to get Nancy Pelosi's permission. Good luck with that.

None of which alters the fact that our President is a mean-spirited, racist, petty, vengeful blowhard.

It's nice to know there are some real Christians left.

Criminalizing Humanity

At least, that what Trump's government (such as it is) would like to do. Didn't work:

Jurors found humanitarian aid volunteer Scott Warren not guilty Wednesday of intentionally harboring and concealing two undocumented migrants from the Border Patrol in the remote Arizona desert.

Warren, a longtime volunteer with humanitarian aid group No More Deaths, faced up to 20 years in prison. It was his second trial stemming from his January 2018 arrest in Ajo, about 100 miles southwest of Phoenix.

The 12-person jury in Tucson took just more than two hours to reach a not guilty verdict, striking a blow to federal prosecutors who opted to retry Warren after the first trial ended in a hung jury in June.

“The government failed in its attempt to criminalize basic human kindness,” Warren told supporters outside the federal courthouse.

I wonder if they would have arrested him if he was giving food and water to immigrants from, say, Slovenia.

And his base thinks this is OK. Even -- or maybe especially -- the "Christians" among them.

Everyone involved in this:

Following a massive undocumented immigration enforcement operation that resulted in more than 650 arrests, many children of those taken into custody are now left homeless with nowhere to go.

Community leaders in Forest, Mississippi came together Wednesday night to put them up in a community gym. 12 News reporter Alex Love was granted permission to talk to community leaders and the children.

These children — some as young as toddlers — were relying on neighbors and even strangers to pick them up outside their homes after school and drive them to a community center where people tried to keep them calm. But many kids could not stop crying for mom and dad.

Good for the community. And please, can we hear from some "Christians" about their "family values"?

Today's Must Read: The "Pundits" Speak

There's a bit of a flap over comments Tom Brokaw made on, I assume, Chuck Todd's show that are -- well, "stupid" comes to mind. Here's the one that stuck out to me:

I also happen to believe that the Hispanics should work harder at assimilation. That's one of the things I've been saying for a long time. You know, they ought not to be just codified in their communities but make sure that all their kids are learning to speak English, and that they feel comfortable in the communities.

Point One: Every immigrant group in the history of this country has tended to settle in their own communities, at least for a generation to two. You're in this new place where everything is not what you're used to, so of course you try to live near people who have the same background.

Point Two: Their kids do learn to speak English, eventually. Sometimes right away. Family history has it that my father, whose parents immigrated before World War I and settled in a Lithuanian community in Southern Illinois, didn't learn to speak English until he started school. And he spoke flawless American Standard English.

As well, I happen to live in a neighborhood with a lot of immigrants from all sorts of places -- East Africa, the Middle East, Latin America, Indian, Pakistan, Russia, you name it. Not only do we all manage to get along with each other, but the kids are usually bilingual, even if the parents are not -- although I do notice that the parents all seem to have some command of English -- it's the only language we all have in common.

So now I'm wondering -- when did Brokaw lose his mind?

The News

I haven't been commenting on the news much the last few days, mostly because I'm fed up with Trump and his wall. Pelosi is tougher than he is, and with her prodding him, Schumer may even show some spine. And we all know that Trump is not going to negotiate in good faith, especially with President Coulter calling the shots.

I can't believe we're going through this over a campaign slogan.

The Lower Depths

keep getting lower. We all know that Donald Trump, who styles himself "president", is a miserable excuse for a human being, but this is beyond the pale.

President Donald Trump on Saturday attempted to blame Democrats for the two deaths of immigrant children being held by his Border Patrol and Customs enforcement officers.

“Any deaths of children or others at the Border are strictly the fault of the Democrats and their pathetic immigration policies that allow people to make the long trek thinking they can enter our country illegally,” Trump claimed.

“They can’t,” he argued. “If we had a Wall, they wouldn’t even try!”

“The two children in question were very sick before they were given over to Border Patrol,” Trump continued.

“The father of the young girl said it was not their fault, he hadn’t given her water in days. Border Patrol needs the Wall and it will all end,” he claimed. “They are working so hard & getting so little credit!”

He's lying about the little girl -- her father said she had been fed and given water.

He's either feeling the heat or figures this is a good excuse to plug the wall (a/k/a a "beaded curtain") again. And of course, he's blaming Democrats for the policies of his administration. Because nothing's ever his fault.

And there's this:

Videos from a Southwest Key shelter for migrant children show staffers dragging and pushing children, incidents that occurred shortly before the federal government suspended the shelter's operations early this fall.

These are children that were separated from their parents by Trump's Department of Homeland Security.

The Lower Depths

keep getting lower. The United States has now "reinterpreted" a 1995 agreement between the US and Vietnam regarding the status of Vietnamese refugees:

The Trump administration is resuming its efforts to deport certain protected Vietnamese immigrants who have lived in the United States for decades—many of them having fled the country during the Vietnam War.

This is the latest move in the president’s long record of prioritizing harsh immigration and asylum restrictions, and one that’s sure to raise eyebrows—the White House had hesitantly backed off the plan in August before reversing course. In essence, the administration has now decided that Vietnamese immigrants who arrived in the country before the establishment of diplomatic ties between the United States and Vietnam are subject to standard immigration law—meaning they are all eligible for deportation.

The new stance mirrors White House efforts to clamp down on immigration writ large, a frequent complaint of the president’s on the campaign trail and one he links to a litany of ills in the United States.

Remember, though, immigrants are only responsible for a "litany of ills" if they're not white.

Read it -- it's a fairly complex situation and the article explains it pretty well, in addition to pointing up the Trump regime's finesse at international relations. (Yes, that was meant to be sarcastic.)

Via Joe.My.God. Some of the comments at Joe's post are pretty interesting -- I had forgotten the number of Vietnamese who settled in the South, particularly in coastal areas. It appears from some of the comments that they are not only accepted, but well integrated into their communities. Chicago also has a substantial and lively Vietnamese community, centered on Argyle street around Broadway. (The traffic jams on weekends of people waiting to get into the parking lot for the Vietnamese market is amazing.) Most of the businesses and a lot of the apartment buildings are Vietnamese-owned.

The Bottom Keeps Getting Lower

Words fail me:

The Trump administration is considering charging immigrants a fee to apply for asylum protection in the United States, according to sources close to the administration.

The proposal, included in a not-yet-finalized draft regulation, would charge applicants, if they are already residing in the US, $50 to apply for asylum. Currently, there is no fee to enter an “affirmative asylum” application. The fee would not apply to those who claim a fear of persecution at ports of entry or those who apply for the protections while in deportation proceedings. There would be no waiver of the fee for those who cannot afford to pay the $50.

How many asylum seekers have $50? I'll let an immigration attorney sum it up:

“The reason we don’t charge for asylum applications is intuitive,” said Juan Camilo Mendez Guzman, an immigration attorney with Pangea Legal Services. “Even if it keeps one person from being able to apply, is that what we are about? We are going to put a dollar amount on not getting sent back to a place of persecution? It’s crazy.”

"Is this what we are about?" It's what we're becoming under Trump and the Republicans. No wonder the world is losing respect for us.

"MAGA"? Trump has no idea what greatness is.

What will it take for the morally bankrupt Trump party to start acting like normal human beings? This is beyond outrageous:

An Associated Press reporter saw U.S. agents shoot several rounds of tear gas after some migrants attempted to penetrate several points along the border. Mexico's Milenio TV showed images of migrants climbing over fences and peeling back metal sheeting to enter.

Honduran Ana Zuniga, 23, also said she saw migrants opening a small hole in concertina wire at a gap on the Mexican side of a levee, at which point U.S. agents fired tear gas at them.

Children screamed and coughed. Fumes were carried by the wind toward people who were hundreds of feet away. . . .

As the chaos unfolded, shoppers just yards away on the U.S. side streamed in and out of an outlet mall.

Today in Trump's America: Worse Than Deplorable

This is just stunning -- a trumpie on immigration:

During a discussion on immigration, Trump supporter Cindy Ruggiero said that she was worried about the caravan of “14,000” migrants headed toward the United States from Central America.

When Camerota and other women on the CNN voter panel told her that she had vastly inflated the number of migrants in the caravan, she brushed it aside and said it was still too many people coming into the country.

She then insisted that she only objected to migrants who enter the country illegally and that she welcomed immigrants who came to the United States while following all the rules.

“Come in the legal way and you are more than welcome,” she said.

Camerota then pointed out that migrants fleeing from violence in Guatemala are not trying to sneak into the United States.

“I mean, it is legal to seek asylum,” she said.

Ruggiero sat in silence for a full six seconds.

“Well, I hope Trump changes that,” she eventually responded.

That's the kind of people who support Trump. The kind of people whose kids you wouldn't let your kids play with. I mean, talk about a moral vacuum: what kind of person wants to bar people fleeing persecution, starvation, violence from seeking asylum here?

Constitution? What Constitution? (Update)

Trump told "Axios on HBO" that he has run the idea of ending birthright citizenship by his counsel and plans to proceed with the highly controversial move, which certainly will face legal challenges.

"It was always told to me that you needed a constitutional amendment. Guess what? You don't," Trump said, declaring he can do it by executive order.

When told that's very much in dispute, Trump replied: "You can definitely do it with an Act of Congress. But now they're saying I can do it just with an executive order."

"We're the only country in the world where a person comes in and has a baby, and the baby is essentially a citizen of the United States ... with all of those benefits," Trump continued. "It's ridiculous. It's ridiculous. And it has to end." (More than 30 countries, most in the Western Hemisphere, provide birthright citizenship.)

"It's in the process. It'll happen ... with an executive order."

"They're saying" again. He must mean the voices in his head.

And joining the chorus, first Sen. Lindsey Graham (R-Ol' Dixie):

Sen. Lindsey Graham (R-S.C.) on Tuesday said that he will introduce legislation to end birthright citizenship after President Trump suggested he wanted to do so through an executive order.

"Finally, a president willing to take on this absurd policy of birthright citizenship. I’ve always supported comprehensive immigration reform — and at the same time — the elimination of birthright citizenship," Graham said in a string of tweets.

He added that he plans "to introduce legislation along the same lines as the proposed executive order" from Trump. Congress is out of session until Nov. 13.

And of course, VP Mike Pence has to jump in:

But Vice President Pence said "we all cherish" the 14th Amendment but appeared to suggest that the administration had an opening if Trump issues an executive order.

"The Supreme Court of the United States has never ruled on whether or not the language of the 14th Amendment subject to the jurisdiction thereof applies specifically to people who are in the country illegally,” Pence said at a Politico event on Tuesday.

Pence is, as usual, playiing word games. while he's correct that the Supreme Court has not ruled specifically on the issue of children born to residents who are not legally in the country, the Court ruled quite definitely on the issue of birthright citizenship in United States v. Wong Kim Ark (1898), which doesn't really leave much wiggle room. (It's also interesting to note how much that decision made use of English Common Law and the Napoleonic Code,, for those who get all worked up about our courts even acknowledging foreign law.) The wording of the Amendment itself is quite plain, and the phrase "subject to the jurisdiction thereof" is quite thoroughly explored in Wong Kim Ark.

In the final analysis, this is going nowhere, but, like most observers, I think it's pretty obvious that this is another of Trump's attempts to get the deplorables to the polls.

Donald Trump, in an interview with Axios, said that he plans to sign an executive order stripping many Americans of their citizenship. Though it is unclear how far Trump wants to go, or whether he would attempt to retroactively strip many existing citizens of their citizenship, Trump apparently wants to target the children of undocumented immigrants.

“We’re the only country in the world where a person comes in and has a baby, and the baby is essentially a citizen of the United States for 85 years with all of those benefits,” Trump falsely claimed. “It’s ridiculous. It’s ridiculous. And it has to end.”

Trump’s plan is unconstitutional. It’s not even arguably constitutional. It is so obviously unconstitutional that it was rejected by a notoriously racist Supreme Court more than a century ago. The few scholars who think that Trump can actually do this are considered radicals even within conservative legal circles.

By the way, that bull-pucky about being the only country in the world with birthright citizenship is, as might be expected, just that: bull-pucky. There are at least 30 other countries who recognize that right.

Today in Right-Wing Hypocrisy

From none other than the holotype of bigoted, hypocritical "Christian":

Sessions was speaking at the Boston Lawyers chapter of the Federalist Society when a man, later identified as United Methodist Pastor Will Green of Ballard Vale United Church in Andover, Mass., interrupted with quoted lines from the Bible.

“I was hungry and you did not feed me. I was a stranger and you did not welcome me. I was naked and you did not clothe me,” Green said. “Brother Jeff, as a fellow United Methodist I call upon you to repent, to care for those in need, to remember that when you do not care for others, you are wounding the body of Christ.”

The pastor was then escorted from the room. Another pastor, identified as Darrell Hamilton of First Baptist Church of Boston, also addressed Sessions and was escorted out.

That quote is from Matthew 25, and is my favorite to throw in the face of these anti-immigrant neo-fascists. But Sessions' response is priceless:

"I don't believe there's anything in my theology that says a secular nation-state cannot have lawful laws to control immigration in this country. That’s what we’re talking about," Sessions said. "It’s not immoral, not indecent and not unkind to state what your laws are and then set about to enforce them, in my view. I feel like that’s my responsibility and that’s what I intend to do.”

That's one of the smarmiest things I've heard from Sessions, who is also the type specimen of smarmy.

So, suddenly the U.S. is a "secular nation"; funny, I could swear that we're a "Christian" nation. And by the way, they're not enforcing the laws; they're making it up as they go along. Note: "the law" is as follows:

8 U.S. Code § 1158 - Asylum

(a) Authority to apply for asylum

(1) In general

Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien’s status, may apply for asylum in accordance with this section or, where applicable, section 1225(b) of this title.

What Trump, et al. are trying to do is circumvent the law to keep their racist, isolationist base happy. That's all.

(2) Exceptions

(A) In generalParagraph (1) shall not apply to an alien if the Attorney General determines that—

(i) the alien ordered, incited, assisted, or otherwise participated in the persecution of any person on account of race, religion, nationality, membership in a particular social group, or political opinion;

Pity the Trump cultists aren't trying to emigrate. Oh, well, you can't have everything.

They Won't Stop Until We Make Them

Not only does the Trump administration have no respect for the law, it has no respect for basic human decency. They're still putting children in concentration camps:

In shelters from Kansas to New York, hundreds of migrant children have been roused in the middle of the night in recent weeks and loaded onto buses with backpacks and snacks for a cross-country journey to their new home: a barren tent city on a sprawling patch of desert in West Texas.

Until now, most undocumented children being held by federal immigration authorities had been housed in private foster homes or shelters, sleeping two or three to a room. They received formal schooling and regular visits with legal representatives assigned to their immigration cases.

But in the rows of sand-colored tents in Tornillo, Tex., children in groups of 20, separated by gender, sleep lined up in bunks. There is no school: The children are given workbooks that they have no obligation to complete. Access to legal services is limited.

These midnight voyages are playing out across the country, as the federal government struggles to find room for more than 13,000 detained migrant children — the largest population ever — whose numbers have increased more than fivefold since last year.

Under American law, anyone who is on U.S. soil has the right to apply for asylum. Also under American law, anyone who needs legal counsel is entitled to have it provided.

And if we're not able to take adequate care of detained children, we really need to get our act together.

Today's Must-Read: Now They're Going After Citizens

who happen to be brown. Tom Sullivan has a post at Hullabaloo that details Trump's attacks on immigrants, or suspected immigrants.

Defense Secretary Jim Mattis last year issued a directive for additional background checks for non-citizen troops and extended the active duty time required before they were eligible to apply for naturalization. Applications dropped 65 percent.

Earlier this summer, news broke that the sitting president had tasked U.S. Citizenship and Immigration Services Director L. Francis Cissna with tracking down and "denaturalizing" American citizens suspected of falsifying their citizenship applications.

In July, AP broke news that the Army had begun discharging foreign-born troops after promising them "expedited naturalization" for service. Those with expired visas now risk deportation.

Immigration and Customs Enforcement (ICE) has detained hundreds of U.S. citizens an average of 180 days, a Northwest University study found last August.

The Washington Post reports today the State Department is denying passports to Americans born along the Texas-Mexico border. Government officials question their citizenship based on suspicion that decades ago midwives may have falsified the birth documents of newborns

I can't help but wonder who's next.

The Height of Stupidity?

Or the depths of ignorance? This story has to be read to be believed. The best summary is at Snopes:

In late January 2018, reports surfaced that supporters of Donald Trump confronted a Native American legislator during an anti-immigration protest at the Arizona state capitol, demanding to know whether he was in the country legally. The viral stories on various web sites (including The Hill and the liberal RawStory.com) were all aggregated from the original reporting of the Arizona Capitol Times, a nonpartisan weekly newspaper focused on Arizona government and state politics.

We confirmed that one of the anti-immigration protesters did indeed ask an indigenous state representative whether or not he was “legal,” both through video footage of the incident and three corroborating interviews with Arizona state legislators who witnessed the scene. In the background of the following video, a protester asks Rep. Eric Descheenie whether he is “legal.” Descheenie is Navajo.

Get that? He's Navajo. His family has been here about 12,000 years longer than the protesters'.

There's really not much to add, except that the anti-immigration protesters were protesting a group that was lobbying for pro-labor legislation, not immigration.

It's worth reading the whole story -- these people were totally out of control.

Today in Trump's America: Campaigning While Black

This is getting just a wee bit beyond ridiculous:

An angry white woman who identified herself as a Trump supporter called police Thursday morning to report a black state senator who was merely talking with voters outside a Brooklyn subway station.

Sen. Jesse Hamilton was speaking with constituents at the Parkside Ave. subway entrance in Prospect-Lefferts Gardens when the woman, who spoke with an Eastern European accent, accused Hamilton of being too strong in his support for immigrants, his office said.

Of course, they have to be the right kind of immigrants.

I don't mean to make light of this sort of thing -- it's really more than a little disturbing. I blame Trump, even though this is a drum the GOP has been beating for decades; Trump is just the useful idiot du jour, but he does spew his racism with gusto. Sadly, he's played into an element that's always been with us and somehow parlayed that into the presidency, which even more unfortunately has given him the bully pulpit as he has gone about destroying our standing in the world. And they still support him even though he's screwing them over.

Today's Must-Read: Into the Abyss

America under the Trump regime is going to start looking like the worst parts of Central America. Two posts at Hullabaloo only point up how morally bankrupt the right has become.

First, this post by Tom Sullivan on the regime's not-in-good-faith attempts to obey court orders to reunite the families it has torn apart:

The court-imposed deadline is less than a week away for the Trump administration to reunite migrant families it forcibly separated a the border as part of its "zero tolerance" approach to refugees. The administration missed a deadline last week for reuniting children under five with their parents. Of the more than twenty-five hundred children in government detention, only 450 between the ages of 5 and 17 have reunited with their parents ahead of the July 26 deadline.

The Department of Health and Human Services and the Department of Homeland Security that found it easy to take children from their parents' arms at U.S.-Mexico border stations find it much more difficult to reunite them. DHS personnel admitted weeks ago that records linking parents and their children have disappeared and in some case destroyed (a DHS spokesperson disputes this). HHS requested volunteers to help pore through case records to match children with their parents.

As you read through, it becomes more and more obvious that Trump's minions have no intention of rectifying this atrocity.

And now there are calls to assassinate "leftists", which is to say, anyone who objects to Trump's policies or his methods.

Here on Hullabaloo, Tom Sullivan recently posted a tweet informing us that Trump supporter Michael Scheuer, an ex-CIA spook, bestselling author and world-class paranoid approvingly mentioned the growing interest on the right in assassinating those opposed to Trump:

As this week’s end, it seems likely that it is quite near time for killing those involved in the multiple and clearly delineated attempts to stage a coup d’état against the legitimately elected [sic] Trump government and thereby kill our republic. 

Finally, this week saw a significant and quickening advance toward the moment when those millions of well-armed citizens who voted for Trump, and who have been abused or wounded by Democrats, their Antifa-thugs, and their thug-civil servants for exercising their franchise to elect Trump, cannot be, in good conscience, patient for much longer.

Fortunately, they have in hand a long and very precise list of the names and photographs...

That's right. Scheur even provided a list of people who it is "quite near time to kill."

This would sound to me like paranoid ravings, except that Trump supporters are already showing up armed at protests -- and let's not forget Charlottesville. Or for that matter, our monthly mass shootings.
